Terms of Service for the Participation of MGM Collection with Marriott Bonvoy in the Marriott Bonvoy™ Loyalty Program

1. INTRODUCTION

The following terms of service (“MGM Collection with Marriott Bonvoy Terms”) apply to the participation of MGM Collection with Marriott Bonvoy (“MGM Collection”) in the Marriott Bonvoy loyalty program (“Loyalty Program”). The MGM Collection with Marriott Bonvoy Terms are hereby incorporated into the terms and conditions that govern the Loyalty Program (“Program Rules”).

Any capitalized terms not defined in these MGM Collection with Marriott Bonvoy Terms will have the meaning ascribed to them in the Program Rules, available at https://www.marriott.com/loyalty/terms/default.mi and incorporated herein by reference. To the extent there is a direct conflict between the Program Rules and these MGM Collection with Marriott Bonvoy Terms, these MGM Collection with Marriott Bonvoy Terms prevail with respect to the Loyalty Program members (“Members”) travelling with MGM Collection.

By participating in the Loyalty Program, you are accepting all the Program Rules, including these MGM Collection with Marriott Bonvoy Terms. It is your responsibility to read them and to comply with them. The Company reserves the right, at its discretion, to change and/or modify the MGM Collection with Marriott Bonvoy Terms at any time without notice and, unless otherwise indicated, such changes will become effective immediately upon posting; therefore, please check these MGM Collection with Marriott Bonvoy Terms periodically for changes. The Company will display the effective date of these MGM Collection with Marriott Bonvoy Terms at the top of this page.

Each Member understands, acknowledges, agrees and hereby directs that personal information associated with such Member’s stay at an MGM Collection Hotel (defined below) may be shared among, and used by, the Company, MGM Resorts International (“MGM”) and MGM Collection Hotels for the purposes described in Company’s Privacy Statement (available at https://www.marriott.com/about/privacy.mi), MGM’s Privacy Policy (available at https://www.mgmresorts.com/privacy↗), and The Cosmopolitan of Las Vegas’ Privacy Policy (available at https://www.cosmopolitanlasvegas.com/privacy-policy) including, but not limited to, facilitating reservations and bookings of hotel accommodations and related services, and administering loyalty programs of both the Company and MGM.

2. PARTICIPATION

Unless otherwise indicated, MGM Collection hotels identified here participate in the Loyalty Program in a unique capacity as expressly stated within these MGM Collection with Marriott Bonvoy Terms (“MGM Collection Hotels”).

Stays at these MGM Collection Hotels participating in the Loyalty Program are bookable through the https://www.marriott.com/marriott-brands/mgm-collection.mi (“MGM Collection Platform”) and select Channels defined in Section 3.

Members who book and stay at an MGM Collection Hotel are subject in all respects to the Program Rules and the MGM Collection with Marriott Bonvoy Terms. Members are subject to the Program Rules and the MGM Collection with Marriott Bonvoy Terms for Stays at The Cosmopolitan of Las Vegas beginning on or after March 6, 2024, when its participation begins with the MGM Collection with Marriott Bonvoy.

3. EARNING LOYALTY PROGRAM POINTS AND ELITE NIGHT CREDIT

Member Eligibility. Members with an active Membership Account in good standing are eligible to receive Loyalty Program Points (hereinafter, “Points”), Elite Night Credit, and other Loyalty Program benefits for completed Stays at MGM Collection Hotels. A “Stay” is a stay of one or more consecutive nights at the same MGM Collection Hotel regardless of check-in and check-out activity by a Member who: (i) provides their Membership Number at the time of reservation, at check-in, or before the end of their stay; (ii) pays a Qualifying Rate; and (iii) stays in one of the reserved guest rooms.

Earn Eligibility. In order to earn Points and Elite Night Credit for Stays at an MGM Collection Hotel, Members must book through a Qualifying Channel, stay on a Qualifying Rate, and provide their correct Membership Number at time of booking, at check-in, or before the end of their stay.

Qualifying Channels. “Qualifying Channels” for booking reservations at MGM Collection Hotels include: Marriott.com; Marriott Mobile Apps; Marriott Customer Engagement Centers; MGM Resorts Call Centers; Participating MGM Travel Agents; MGM Collection Hotels; and other channels designated as a Qualifying Channel by the Company and MGM.

Nonqualifying Channels. “Nonqualifying Channels” for booking reservations at MGM Collection Hotels include: MGM Resorts Websites; MGM Rewards Website; MGM Rewards Mobile App; Tour Operators; Online Travel Channels; Marriott Travel Agents; or other channels not designated as a Qualifying Channel by the Company and MGM.

Qualifying Rates. A “Qualifying Rate” is the rate a Member pays for a Stay in a guest room which qualifies to earn Points or Miles. Qualifying Rates include most rates found on Marriott channels including Award Redemption rates, standard and premium retail rates, and prepay rates, as well as select prevailing rates booked through MGM Resorts Call Centers, and participating MGM Travel Agents. Unless otherwise specifically stated, Members will receive their membership tier benefits during Stays on Qualifying Rates (each a “Qualifying Stay”).

Nonqualifying Rates. A “Nonqualifying Rate” is a rate a Member pays for a stay in a guest room which does not qualify to earn Points or Elite Night Credit nor receive membership tier benefits. Nonqualifying Rates are booked using Nonqualifying Channels and/or the following methods:

  • The guest room was booked through a tour operator, online travel channel or other third-party channel including, without limitation, expedia.com, hotwire.com, priceline.com, orbitz.com, booking.com, travelocity.com, alibaba.com, rakuten.com; or
  • The guest room was booked at a group rate as part of an event, meeting, conference or organized tour except as provided below with respect to The Cosmopolitan of Las Vegas; or
  • The guest room was booked at a tour operator, wholesaler, or crew room rate or package including, without limitation, organized tours or package bookings; or
  • The guest room was complimentary; or
  • A voucher or third-party award was redeemed for the guest room; or
  • The guest room was booked through an MGM Resorts website, MGM Rewards Website, or the MGM Rewards mobile app; or
  • The guest room was booked through the MGM Resorts Call Center on a non-prevailing rate such as casino offers, MGM Rewards member discounts, etc.; or
  • Other rates not designated as a Qualifying Rate by the Company and MGM.

At The Cosmopolitan of Las Vegas, a guest room booked at a group rate as part of an event, meeting, conference or organized tour and personally billed to the Member is considered a Qualifying Rate. A guest room booked at a group rate where the Member does not directly pay the hotel for such room is considered a Nonqualifying Rate.

Base Point Earn. Members will earn ten (10) base Points for each U.S. dollar, or the currency equivalent, on Qualifying Charges (defined below) that are incurred and paid for by the Member when staying on a Qualifying Rate. Members do not earn Points on stays on a Nonqualifying Rate even if they incur charges that would otherwise qualify (e.g., in-room minibar purchases or in-room dining).

Qualifying Charges. “Qualifying Charges” for Stays on Qualifying Rates at MGM Collection Hotels include:

  • Qualifying Rates for Stays;
  • Food and beverage purchased through in-room dining (excluding alcoholic beverages where prohibited by law);
  • In-room minibar purchases (excluding alcoholic beverages where prohibited by law); and
  • Other charges designated as a Qualifying Charges by the Company and MGM

so long as the Member provides their Membership Number at the time of reservation, at check-in, or before the end of their stay; stays in one of the reserved guest rooms; and pays for the charges.

Nonqualifying Charges. “Nonqualifying Charges” for Stays at MGM Collection Hotels which do not qualify for earning Points include:

  • Nonqualifying Rates for stays;
  • Award Redemptions;
  • Charges for banquets, meetings or other functions;
  • Room and other taxes;
  • Service charges;
  • Gratuities;
  • Resort fees;
  • Other charges incurred at the hotel including, but not limited to, parking, food and beverage at outlets, spa services, business center, and retail stores;
  • Other third-party services;
  • Charges that are direct billed to a company that has arranged payment for the Member’s stay that is not associated with a convention or group meeting;
  • Other fees paid including room upgrade fee, early check-in fee, late cancellation fee, early departure fees, no-show fees for not checking in even if the reservations were paid in full, mandatory or automatic charges, and other applicable charges; and
  • Other charges not designated as a Qualifying Charge by the Company and MGM.

Multiple Room Earn. A Member may earn Points on Qualifying Charges for up to three (3) guest rooms with the same check-in and check-out dates during any Stay if the Member stays in one of the reserved guest rooms and pays a Qualifying Rate or applies an Award Redemption for all of the guest rooms.

Elite Bonus Points. Elite bonus Points will be awarded on the base Points earned during Stays at a Qualifying Rate and depends on the Member’s achieved Elite Member Tier. More information available in Section 5.

Elite Night Credit. Elite Night Credit will be awarded for each night of a Stay at a Qualifying Rate for the guest room the Member personally pays for and stays in, and not for any additional guest rooms the Member may have paid for.

Miles Earn. Members may earn Miles instead of Points by selecting their earning preference as such through their Membership Account profile online, prior to check-in. Additional information on earning miles instead of Points is available in the Program Rules.

Marriott Bonvoy Events. MGM Collection Hotels do not participate in Marriott Bonvoy Events. At The Cosmopolitan of Las Vegas, eligible Members may earn Points or Miles and Elite Night Credit for eligible groups, meetings and events in connection with Marriott Bonvoy Events under a Qualifying Event Agreement (as defined in section 5.4 of the Loyalty Program Terms & Conditions). Points Posting. Provided that the correct Marriott Bonvoy Membership Account Number is added at time of booking or before the end of the Stay, Points should automatically appear in the Member's Account within ten (10) days following the completion of their Stay.

Identity Membership & Rewards Program at The Cosmopolitan of Las Vegas. For Stays at The Cosmopolitan of Las Vegas, Members who hold dual membership in both the Marriott Bonvoy Loyalty Program and The Cosmopolitan of Las Vegas Identity Membership & Rewards program (“Identity Program”) can choose to receive the benefits of, and apply their room charges and in-room consumable earnings to, either program, but cannot concurrently receive the benefits of nor apply earnings to both. Marriott Bonvoy and the Identity Program are two separate loyalty programs; therefore accounts may not be linked or merged. Members may elect to earn Marriott Bonvoy Points and receive Marriott Bonvoy program benefits by providing their Membership Number at the time of reservation. Identity Program is the loyalty program of The Cosmopolitan of Las Vegas, which will be transitioning to MGM Rewards Program in 2024. MGM Rewards Program. Members who hold membership in both Marriott Bonvoy Loyalty Program and MGM Rewards Program can choose to receive the benefits of, and receive earnings from Qualifying Charges from either program, but cannot concurrently receive the benefits of, nor receive earnings from Qualifying Rates and Qualifying Charges to both. Marriott Bonvoy and the MGM Rewards Program are two separate loyalty programs; therefore, accounts may not be merged.

Marriott Bonvoy Loyalty Program Members who also hold membership in MGM Rewards program may be eligible to earn MGM Rewards points on select Nonqualifying Charges (i.e., select Food and Beverage, Spa, Salon, and Entertainment charges) at participating MGM Rewards destinations. 4. REDEEMING LOYALTY PROGRAM POINTS

Award Redemption. Unless otherwise noted, a Member may redeem Points for a Standard Redemption Award, as well as apply a Free Night Award for a night in a standard room (with existing bedding configuration) at an MGM Collection Hotel (“Award Redemption Stay”). Instant Redemption Awards are not offered at MGM Collection Hotels. Other redemption options including Premium Room Redemption Awards, Cash + Points Awards, and PointSavers™ Awards may be offered at The Cosmopolitan of Las Vegas, and are not offered at other MGM Collection Hotels. Subject to Availability. The ability to use an Award Redemption for a Stay at an MGM Collection Hotel is subject to availability at the time of reservation and must be booked through Marriott.com, Marriott Mobile App, or Marriott Customer Engagement Centers.

Award Redemption Reservation. When making a reservation for an Award Redemption Stay, the required Points and/or applied Free Night Award(s) will be deducted and the Award Redemption will be attached to the reservation automatically, provided the Member has sufficient Points for the entire stay and/or sufficient Free Night Award(s) as described in Section 3.3.c of the Program Rules, as applicable. Award Redemption Stays are valid only for individual travel and are not valid for group travel, package tours, conventions or other special rates and/or package programs.

Gifted Award Redemption Stays (Third Party Transfers). Award Redemption Stays are valid only for use by the Member from whose Account the Award Redemption Stay was processed and are not transferable, except as set forth in Section 3.2.c. of the Program Rules (“Gifted Award Redemption Stays”) available at https://www.marriott.com/loyalty/terms/default.mi#redeem.

Guarantee and Cancellation Policies. The standard guarantee and cancellation policies of the MGM Collection Hotel will apply to Award Redemption Stay reservations including, without limitation, all minimum length of stay requirements, credit card guarantee requirements and charges for late cancellation, no-shows, and early check-out.

A Point refund may be issued for a Stay that is less than the number of days on the Redemption Award, but the Member must inform the MGM Collection Hotel’s front desk in advance of the early check-out time in order for the Point refund to be issued to the Member’s Account.

If a Member fails to cancel a guaranteed Award Redemption Stay reservation within the permitted cancellation period, the MGM Collection Hotel will charge the applicable cancellation fee to the credit card provided by the Member at the time the reservation was made and the Points that were redeemed will be re-deposited into the Member’s Account.

Amount of Points Required. The amount of Points required per night to obtain rooms at MGM Collection Hotels varies by the individual hotel, the room types available, date and length of stay, and may also vary by time of year or during special events. Points required per night are updated continuously and may change at any time. If the Member makes a modification to the Award Redemption Stay, the Member is responsible for the changes to the Points required.

Award Redemption Stay Inclusions & Exclusions. An Award Redemption Stay at an MGM Collection Hotel covers the cost of a guest room (with existing bedding configuration), room tax, service charge, and extra-person charges, if any. All other charges, including incidentals, resort fees, rollaways, and other fees, are the responsibility of the Member and are not included in the Award Redemption Stay.

With an Award Redemption Stay, bedding, and other room preferences may be requested, but are not guaranteed.

Elite Night Credit on Award Redemption Stays. An Award Redemption Stay at an MGM Collection Hotel is considered a Qualifying Stay and as such the Member will receive Elite Night Credit toward earning Elite Membership Status or Lifetime Elite Membership Status. A Member who uses an Award Redemption will only receive Elite Night Credit(s) for the guest room in which the Member stays and will not receive Elite Night Credits for additional guest rooms.

Stay for 5, Pay for 4 Offer. MGM Collection Hotels participate in the Stay for 5, Pay for 4 Offer. For more information, refer to Section 3.3.d of the Program Rules available at https://www.marriott.com/loyalty/terms/default.mi#redeem.

Exit of MGM Collection Hotel. If an MGM Collection Hotel exits the Loyalty Program for any reason after a Member makes an Award Redemption Stay reservation but before the Member’s stay, the Company will use reasonable efforts to have such former MGM Collection Hotel honor the reservation or assist in arranging equivalent accommodations nearby; however, the Company cannot guarantee that any Awards, upgrades or any other benefits a Member may earn under the Loyalty Program will be honored.

Limited Blackout Dates. MGM Collection Hotels may have a limited number of standard rooms available for redemption on a limited number of days.

Marriott Gift Cards. The Cosmopolitan of Las Vegas may offer and accept Marriott Gift Cards. Marriott Gift Cards are not offered or accepted at any other MGM Collection Hotels.

5. MEMBER BENEFITS

The following benefits are provided to Members during Stays at a Qualifying Rate (each a Qualifying Stay) at MGM Collection Hotels that were booked through a Qualifying Channel. Unless otherwise stated, benefits apply solely to the one guest room in which the Member stays. Some benefits are based on availability and may vary by Hotel, as set forth below. Benefit information is provided after the benefit chart. Other benefits not listed below but are still available to eligible Members include Dedicated Elite Support, Annual Choice Benefit, and Ambassador Service. Information on these other benefits and additional terms for Elite Membership are available in the Loyalty Program Rules at https://www.marriott.com/loyalty/terms/default.mi#elite.

Points Bonus. Points Bonus percentages vary by Elite membership level and are calculated based on base Points earned during a Stay.

Elite Welcome Gift. Gold Elite Members receive one Elite Welcome Gift of 500 Points on a Stay of one or more consecutive nights as described in 2.1.d of the Program Rules, even if they check in and check out of the same MGM Collection Hotel within 24 hours.

Platinum Elite Members and above receive one Elite Welcome Gift of their choice on a Stay of one or more consecutive nights as described in 2.1.d of the Program Rules, even if they check in and check out of the same MGM Collection Hotel within 24 hours. Platinum Elite Members and above may choose an Elite Welcome Gift of either 1,000 Points per Stay or a U.S. $15 Food & Beverage credit per night of Stay (each a “F&B Credit”) for the Member. The F&B Credit is valid for use on the calendar day immediately following the night for which it is awarded and is not valid for use on the date of check-in. F&B Credits do not accrue during the Stay and any unused value of a F&B Credit will be forfeited. For example, a Member who does not use the F&B Credit on one day does not receive a U.S. $30 F&B Credit to use the following day. A F&B Credit may only be applied toward food and beverage purchases at select participating MGM Collection outlets and cannot be applied toward gratuities. A F&B Credit is not valid for in-room dining or mini-bar purchases. To receive proper credit, eligible purchases at participating outlets must be billed to the Member’s room during their Stay, prior to checkout. Outlet participation and hours of operation may vary and are subject to availability. F&B Credits have no cash value. In the event of early departure, any unused F&B Credits are forfeited.

Enhanced Room Upgrades. Platinum Elite Members and above may receive a complimentary upgrade to an enhanced room, subject to availability upon arrival, for the entire length of stay. Enhanced room upgrade includes rooms with desirable views, rooms on high floors, corner rooms, or rooms with special amenities within the same room type booked by the Member. For Ambassador Elite Members, enhanced room upgrade may also include suites. Enhanced room upgrades are subject to availability and are identified by each MGM Collection Hotel.

Priority Check-in Line. Platinum Elite Members and above may access dedicated Priority Check-in line with Marriott Bonvoy signage at the front desk of MGM Collection Hotels.

Late Checkout. Platinum and Titanium Elite Members may call the front desk the morning of checkout and request a late checkout up until 2 p.m. local hotel time. Ambassador Elite Members may call the front desk the morning of checkout and request a late checkout up until 4 p.m. local hotel time. This benefit is based on availability. Late checkout benefit is only available during the promotional period commencing at the participation of the MGM Collection Hotel and ending December 31, 2024.

Ambassador Elite Member Promotional Benefits. Ambassador Elite Members are eligible to receive the following benefits at MGM Collection Hotels on Stays at a Qualifying Rate (each a Qualifying Stay). These benefits are only available during the promotional period commencing at the participation of the MGM Collection Hotel and ending December 31, 2024:

  • Waived Resort Fee. Applicable daily resort fees will be waived on up to two room reservations on a Qualifying Stay that are under the eligible Member’s name and Membership Number. To redeem, the eligible Member may be required to visit the front desk during their Stay to confirm eligibility and request waiver of the daily resort fee.
  • 1pm Early Check-in. Eligible Members may contact the Hotel a minimum of 24 hours prior to arrival to request complimentary early check-in of 1 p.m. local hotel time. This benefit is based on availability.
  • One Suite Upgrade per Year in Las Vegas. Eligible Members may receive one (1) upgrade from a standard room type to standard suite at an MGM Collection Hotel in Las Vegas once per calendar year redeemable for a single Stay. Eligible Members must request Suite Upgrade with their personal Ambassador prior to arrival. Subject to availability. Room and suite types covered by the offer may vary by Hotel and are determined in the Hotel’s sole discretion. Reservation not to exceed 3 nights.
  • Complimentary Self-Parking. Eligible Members may receive complimentary self-parking during their Stay; subject to availability. To receive this benefit, Members may be required to visit the front desk during their Stay and must provide proof of valid Ambassador Elite status by presenting their Membership card in the Marriott Bonvoy Mobile App.
  • Expedited Valet and Taxi Service. Eligible Members may receive expedited service at select valet parking outlets and taxi queues; subject to availability. To receive this benefit, eligible Members must provide proof of valid Ambassador Elite status by presenting their Membership card in the Marriott Bonvoy Mobile App.
  • Guaranteed Hotel Reservations Within 24 Hours. Limited to the eligible Member’s personal guest room. Guaranteed reservation availability for reservations booked at least twenty-four (24) hours prior to arrival and available when an MGM Collection Hotel is sold out if the room is booked by 3 p.m. local hotel time, twenty-four (24) hours prior to arrival. Benefit may not be available on certain limited dates (e.g., special events). Enhanced room upgrade benefits do not apply. Benefit cannot be used in conjunction with Award Redemption Stays or any type of promotional or discounted rates. Eligible Members must pay prevailing rate at the time of booking and length of stay requirements must be met.
  • Retail Discount. Eligible Members may receive a 15% discount at select participating retail outlets. To receive this benefit, eligible Members must provide proof of valid Ambassador Elite status by presenting their Membership card in the Marriott Bonvoy Mobile App at the time of purchase. Discount not applicable to all items. Some exclusions apply and may vary by outlet.
  • Fine Dining Priority Reservations. Eligible Members may receive priority access to reservations at select fine dining restaurants during their Stay; subject to availability. To receive this benefit, eligible Members must request reservations 48-hours in advance with their personal Ambassador.
  • Dedicated Lines at Participating Restaurants, Buffet, Cashier Cages. Eligible Members may access dedicated lines at select restaurants, buffets, and cashier cages for expedited service. To receive this benefit, eligible Members must provide proof of valid Ambassador Elite status by presenting their Membership card in the Marriott Bonvoy Mobile App.
  • VIP Line Access at Select Nightclubs. Eligible Members and up to one (1) guest may access dedicated lines at select nightclubs in Las Vegas. To receive this benefit, eligible Members must provide proof of valid Ambassador Elite status by presenting their Membership card in the Marriott Bonvoy Mobile App.
  • Priority Access at Pool Cabana, Spa, and Salon Reservations. Eligible Members may receive priority access to reservations at select pool cabanas, spas, and salons during their Stay; subject to availability. To receive this benefit, eligible Members must provide proof of valid Ambassador Elite status by presenting their Membership card in the Marriott Bonvoy Mobile App.
  • Discounts to Select Shows. Eligible Members may receive a discount off the published ticket price at select shows. Discount subject to availability and not applicable to all shows. To receive this benefit, eligible Members must provide proof of valid Ambassador Elite status by presenting their Membership card in the Marriott Bonvoy Mobile App to the ticket box office at time of purchase.
  • Priority Access at Select Shows and Entertainment Venues. Eligible Members may receive priority access to dedicated ingress and/or concession lines at select shows and entertainment venues. Benefit subject to availability and not applicable to all shows or venues. To receive this benefit, eligible Members must provide proof of valid Ambassador Elite status by presenting their Membership card in the Marriott Bonvoy Mobile App.

Benefit Exclusions. Other benefits provided by Participating Properties as outlined in the Loyalty Program Rules that are not offered at MGM Collection Hotels include without limitation:

6. ADDITIONAL TERMS

Adjustments. After ten (10) days from completion of a Qualifying Stay at an MGM Collection Hotel, Members may request credits for Points, Miles, or Elite Night Credit that are not reflected in a Member’s Account through the Member Account Activity page on the Loyalty Program website under “Report a Missing Stay”, or by contacting Member Support.

 

  • A Member may request credits for Points/Miles or Qualifying Nights for Elite Status earned in connection with a Qualifying Event at The Cosmopolitan of Las Vegas that are not reflected in a Member's account by contacting the Hotel where the Qualifying Event was held.
  • Such requests must be received within one (1) year of the applicable Qualifying Stay or Qualifying Event to receive any credit.

Correction of Benefit. At any time and in the Company’s sole discretion (including, without limitation, where a Member was not eligible to earn a specific benefit pursuant to these Program Rules), the Company may correct (i) the amount of Points or the number of Elite Night Credits to a Member’s Account, and (ii) any other benefit that has been credited to a Member’s Account, including, without limitation, any Elite Membership Status or Lifetime Elite Membership Status. The Company also reserves the right, in its sole discretion, to prevent, cancel, or reconcile any transaction where the Loyalty Program suspects there has been fraudulent activity connected with the transaction.

Exit of MGM Collection Hotel. If an MGM Collection Hotel exits the Loyalty Program for any reason, a Member will not earn Points or Elite Night Credit (including, without limitation, any Points for a Qualifying Stay) for Stays at such MGM Collection Hotel, and any Awards, other promotions and special offers will no longer be valid after the date on which the MGM Collection Hotel exited the Loyalty Program, even if the reservation for a stay at the former MGM Collection Hotel was made prior to that date.
